My Spouse Has A College Degree, But Refuses To Get A Job.

My spouse has a college degree, but refuses to get a job.  Will the court consider this in determining the amount of child support?

The earning capacity of your spouse may be considered instead of current income.  The court can look at your spouse’s work history, education, skills, health, and job opportunities.  The court can impute income to your unemployed spouse.

If you believe your spouse is earning substantially less than the income she or he is capable of earning, provide your attorney with details.  Ask about making a case for child support based on earning capacity instead of actual income.
