SHOULD I SIGN A WAIVER OF SERVICE AND CITATION EVEN IF I DON’T AGREE WITH WHAT MY SPOUSE HAS WRITTEN IN THE PETITION FOR DIVORCE?

Should I sign a waiver of service and citation even if I don’t agree with what my spouse has written in the petition for divorce?

Signing the waiver of service and citation does not mean that you agree with anything your spouse has stated in the divorce petition or anything that your spouse is asking for in the divorce.

Signing the waiver of service and citation only substitutes for having the sheriff personally hand you the documents. You do not waive the right to object to anything your spouse has stated in the petition for divorce.

Follow your attorney’s advice on whether and when to sign a waiver of service and citation.
