Social Security Benefits and Divorce: When can you collect benefits?

Clients wonder if they can collect on their former spouse’s social security benefits if he or she passes on before the client does. The answer is, “it depends.” You may be eligible to receive benefits if:

• You were married to your spouse for ten or more years
• You are not remarried
• You are at least sixty-two-years old
• The benefit you would receive based on your own earning record is less than the benefit you would receive from your former spouse.

If you visit your local social security office, the representative can advise you what you may be entitled to.
