What is a motion?

A motion is a request that the judge enter a court order of some type. For example, your attorney may file a written motion with the court asking for an order related to temporary custody, child support., parenting time, or financial matters, such as payment of bills.

Some motions are made to handle certain procedural aspects of your case, such as a motion for a continuance asking that a court date be changed or a motion for extension of time asking that the court extend a deadline. In some cases a motion may be made orally rather than in writing, for example when an issue arises during the course of a court hearing or trial. However, in Louisiana, motions are usually written.
