Will My Children Be Present If We Go To Court?

In most instances, no.  Judges make every effort to protect minor children from the conflict of their parents.  For this reason, most judges will not allow children to be present in the courtroom to hear the testimony of the other witnesses.

Although the risk that your spouse may share information with your child cannot be eliminated, it would be highly unusual for a judge to allow a child to hear such testimony in a courtroom.
