In Louisiana, the divorce judgment can be granted without a property settlement taking place. Once you have reached a property settlement, the provisions in your property settlement agreement dealing with the distribution of your assets and debts are not modifiable. Absent an uncommon instance of fraud, duress, or newly discovered evidence, the property settlement agreement cannot be modified.  For example, if one spouse has a retirement plan and no mention is made in the property settlement agreement, the court can consider that the parties merely neglected to list the retirement plan and the asset could still be divided.
