What does date of valuation mean?

Because the value of assets can go up or down while a divorce is pending, it can be necessary to determine a set date for valuing the marital assets.  This is referred to as the date of valuation.  You and your spouse can agree on the date the assets should be valued.  If you cannot agree, the judge will decide the date of valuation.

The most common date used is the date of the filing of the divorce petition.  The court can also use the date of the partition trial when valuing items such as houses and vehicles.
